
SMS/Text Message Policy
Mindfeeder LLC offers an SMS/Text messaging service to communicate with users who opt in. This SMS/Text Message Policy (also called our “SMS Terms & Conditions” or “SMS Disclosure”) describes the terms and conditions under which we send text messages, your rights and obligations, and how to get help or opt out. By providing your mobile phone number and opting in to receive text messages from us (for example, by checking an SMS consent box on a form or texting a keyword to our number), you agree to this policy.
Important: We adhere to the Telephone Consumer Protection Act (TCPA) and other relevant laws governing text communications. We only send you text messages if you have given consent (opted in), and you can opt out at any time. Message and data rates may apply to messages we send or that you send (as imposed by your mobile carrier – we don’t charge any texting fees). We DO NOT share or sell consumer personal information.
1. Program Description
When you opt-in to Mindfeeder’s text messaging service, you can expect to receive SMS and/or MMS messages relevant to your interactions with us. These messages may be sent using an automatic telephone dialing system for efficiency, and by opting in you consent to receive automated texts. The types of text messages you might receive include:
- Appointment Reminders & Scheduling: If you request a free consultation or meeting with us, we may send a text to confirm the appointment date/time or provide a reminder as it approaches.
- Follow-up on Inquiries: If you reach out to us (e.g., via our contact form or chat) and provide your phone number, we might text you to follow up on your request, answer questions, or continue the conversation if that’s convenient for you.
- Service Updates: Updates about the services you have expressed interest in, such as a brief check-in or tips/resources related to digital marketing or business growth, especially if it’s part of our coaching follow-up.
- Transactional Alerts: If you are a client, we might use text messages for time-sensitive communications, such as notifying you that a report is ready, a meeting link has been emailed, or similar non-promotional alerts.
- Occasional Promotional Messages: Very rarely, we may send a promotional message (for example, an announcement of a new service offering, a special event, or a limited-time opportunity to schedule a free workshop). These will be infrequent – our primary use of texting is for transactional or relationship communications, not general marketing blasts. If promotional messages are sent, they will be sent only to users who have opted in to receive marketing texts, and they will always provide info on how to opt out.
We will not send you messages unrelated to Mindfeeder’s business. We will not, for example, send generic advertisements or share your number with third parties for their texting campaigns. All texts will come either from our dedicated number (816-459-0933) or a short code/alternative number that we will communicate to you if used.
2. Frequency of Messages
Message Frequency: The number of text messages you receive will vary based on your interactions with us and what you have opted in to. We anticipate the following frequency:
- For someone who fills out a contact form and opts into SMS, you might receive an initial reply and perhaps 1-3 follow-up texts to schedule and recap a consultation.
- If you become a client, during active projects you might receive text reminders or check-ins occasionally (perhaps a few times a month, depending on project needs).
- If you signed up for purely informational/promotional updates via text, expect at most 1-2 messages per month (if that – again, we plan to use promotional texts sparingly).
- In many cases, you will only receive texts in response to your actions. For example, if you text us a question, we’ll respond. If you haven’t engaged or we have no updates, we generally will not initiate random messages.
We aim to keep texting relevant and minimal – no excessive messaging or spam. Message frequency may vary and sometimes increase around specific events (e.g., confirming an upcoming meeting might involve a couple of messages back and forth in a day). But overall, you will not receive more text messages than a reasonable person would expect for the given communication purpose.
If at any point you feel you are receiving too many texts, please let us know or simply opt out (see Section 3). Your feedback is important, and we will happily adjust.
3. Opt-Out (How to Stop Messages)
You can stop receiving SMS messages from Mindfeeder at any time. Here’s how:
- Reply “STOP”: The easiest way to opt out is to reply to any Mindfeeder text message with the word STOP. You can also send “STOP” to our contact number (816-459-0933) even if you haven’t recently received a message from us. This is a universally recognized command to unsubscribe. After you text STOP, we will send you a confirmation text to let you know you have been unsubscribed. (Example: “You have been unsubscribed from Mindfeeder texts. You will no longer receive messages.”) Please note: After this, you will not receive further SMS messages from us, unless you decide to opt-in again in the future.
- Alternate STOP Keywords: We monitor common stop phrases as well. Phrases such as “STOP ALL”, “END”, “CANCEL”, “UNSUBSCRIBE”, or “QUIT” will also be recognized as opt-out requests for our texting service. Any of these, if sent to us, will trigger the stop process as described above.
- Contact Us to Opt-Out: If for some reason you are unable to send a text, you may also opt out by contacting us through other means. For example, email us at support@mindfeederllc.com or call 816-459-0933 and request to be removed from SMS communications. We can manually remove your number from our texting list. (Note: If you use this method, please provide the phone number that you want opted out, especially if it’s different from the number on file.)
- Opting Back In: If you have opted out and later decide you want to re-subscribe, you will need to opt in again. You can do this by, for example, texting the keyword START to our number or signing up again on our website (if an option is available) and checking the consent box. Once you opt back in, the terms of this policy will apply again.
We process opt-out requests immediately. Thereafter, you should not receive any more text messages. If you continue to receive messages despite opting out, please contact us so we can investigate and ensure your number is properly removed.
4. Getting Help or Support
If you need assistance with our SMS service or have any questions, you have a few options:
- Text “HELP”: You can reply to any of our messages with the keyword HELP. We will respond with a message acknowledging your request and providing instructions on how to contact support. (Example of our likely HELP response: “Mindfeeder SMS: For help, call 816-459-0933 or email support@mindfeederllc.com. Reply STOP to cancel. Msg&Data rates may apply.”)
- Contact Us Directly: You can always reach out for help by emailing support@mindfeederllc.com or calling 816-459-0933. We are available during our business hours (which we will specify, e.g., Mon-Fri, 9am-5pm Central Time) to assist you. If you have any issues like not receiving messages you expected, or technical difficulties, or you have questions about your opt-in status, let us know and we’ll work to resolve it.
- Website Contact: Alternatively, you may use our website contact form to send a message (just mention that it’s regarding SMS), and we’ll follow up via email or phone as appropriate.
We aim to be responsive to all help requests. Generally, you can expect a response within one business day or sooner.
5. Participating Carriers & Disclaimers
Our SMS service is compatible with most major mobile carriers in the United States. This typically includes (but is not limited to) carriers such as AT&T, Verizon, T-Mobile, Sprint, US Cellular, Boost, Cricket, MetroPCS, and others. Please note:
- Carrier Liability: While we (and our text messaging platform provider, if we use one) will send messages through reliable routes, your mobile carrier is not liable for delayed or undelivered messages. Once we send a text, it’s largely in the hands of the carrier networks to deliver it promptly. Occasionally, issues like network congestion, coverage gaps, or carrier filtering can cause delays or message loss. By opting into our texts, you acknowledge that this risk exists and it’s beyond Mindfeeder’s control. We are also not liable for technical issues on the carrier side, but we will make reasonable efforts to retry or resolve delivery problems if we detect them.
- Device Requirements: To receive SMS or MMS messages, you must have a text messaging-enabled mobile device and use a service plan that includes text messaging. If your phone is turned off, out of coverage, or cannot receive texts for other reasons, you might miss messages. We are not responsible for any such issues if they are due to your device or carrier service.
6. Message and Data Rates
Mindfeeder does not charge you any separate fees to receive or send text messages. However, standard message and data rates may apply as per your mobile phone plan:
- If you have an unlimited texting plan, you likely won’t incur additional charges for our texts (aside from your regular monthly bill).
- If you pay per message or have a limited number of texts, each Mindfeeder SMS you receive (or send, like a reply) could count against your allotment and/or incur a fee from your carrier.
- The same applies for data if we send any MMS (multimedia) messages with images or if clicking a link in a text uses data.
For specifics on fees, please check with your mobile carrier. You are responsible for any charges from your carrier for SMS messages you receive or send in connection with our service. By opting in, you accept responsibility for any such charges.
If you’re unsure about your text messaging plan, we recommend contacting your wireless provider before subscribing to our texts.
7. Privacy
We value your privacy and handle your personal information, including your phone number and any personal data in text messages, in accordance with our Privacy Policy. Some key points:
- We will use your mobile number solely for purposes you’ve consented to – which is to send you texts as described. We do not sell your phone number or personal information to third parties.
- Content of text messages may be stored by us (for record-keeping, especially if you become a client or have on-going communications). We treat these communications as confidential. However, remember that text messaging is not a fully secure or encrypted medium; sensitive personal or confidential business information is best shared through more secure channels.
- We will not spam you. All messages will be thoughtful and relevant to your relationship with Mindfeeder. If you ever receive a message that seems suspicious or not from us, please notify us.
- If you have questions about privacy related to SMS (for instance, how we document consent or how to request deletion of your number), please refer to the Privacy Policy or contact us.
By opting into our SMS program, you also agree to our Privacy Policy. We encourage you to review it to understand how we collect and use data.
Consent Reminder: By providing your phone number and confirming your opt-in (e.g., via a checkbox or replying YESText), you consent to receive automated marketing and transactional text messages from Mindfeeder LLC at that number. Consent is not a condition of purchase (and in fact, our services are typically contracted separately and do not require opting into texts). You can still inquire and work with us without agreeing to SMS communication – we offer email and phone as alternatives.
8. Additional Terms
- No Guarantee of Delivery: We are not responsible for messages that are lost, undelivered, or late due to factors outside our control (as noted under carrier liability). The service is provided on an “as is” basis.
- Opt-In Confirmation: When you first opt in, you should receive a welcome message confirming your subscription. If you believe you have opted in but did not receive a confirmation, please check that you entered the correct number or contact us to troubleshoot.
- Short Code Use: If in the future we use a short code for bulk messaging (e.g., a 5- or 6-digit number for campaigns), we will update our policy and let you know. The same STOP/HELP commands will apply.
- Contact Changes: If you change or deactivate the phone number you provided to us, please let us know by emailing or calling us. This is important so we can stop sending messages to the old number. Mindfeeder cannot be responsible for messages that go to a number that has been reassigned if we were not informed of the change.
- Modifications to Policy: Mindfeeder may revise this SMS/Text Message Policy at any time. We will update the “Last Updated” date at the top accordingly. If you are an active subscriber, we may also text you a notice of significant changes or include a mention in a message. Your continued consent to receive our texts after changes indicates your acceptance of the revised terms.
- Compliance: Our SMS program is intended to comply with all applicable U.S. laws (like TCPA and CAN-SPAM for texts, etc.) and guidelines (CTIA messaging principles). We also make sure to only text individuals who have given consent. If you believe you have received an unsolicited text from us or have any compliance-related questions, please contact us immediately.
By opting in to our SMS communications, you acknowledge that you have read and agreed to this SMS/Text Message Policy. Thank you for allowing us to communicate with you via text — we will do our best to make it useful and respectful of your time and preferences.
